  • 6 Jul 1929: WORKED 6 MONTHS FOR NOTHIHG. Yet He Owed £426. "JOHN SMITH" IN BUSINESS.
    The affairs of John Smith, a Greek lately carrying on a business as fruiterer in partnership with Nicholas Mathew, were investigated by the Registrar in Bankruptcy yesterday.
    In reply to Mr. R. J. Burnett (for the Public Curator) Smith said that his real name was Tonakis. He came to Australia 17 years ago.
    Mr. Barnett: When did you get the name of John Smith?
    Witness: I got it just lately, for business reasons.
    In reply to further questions he said that he had used the name of Smith for six years. The amount of his debt to various creditors was £426 19s. In 1923 he worked for the proprietor of a Queen-street cafe for six months and received no wages. "I was caught," he said. Witness said that he had carried on the business of fruiterer in George street, for three years, at West End for a few months, and in Stanley street, South Brisbane, for nine months. On October last he sold a lease in Stanley-street, for £250 to Calluthers, to whom he owed £140. He sold it after he got a summons, which resulted in a judgment in favor of another creditor named Girdis. He did not do this to beat Girdis. He preferred to pay some creditors before others, because they had helped him and might do so again.
    Mr. Barnett: Like all your country men, you were doing pretty well?
    Witness: I don't know.
    Mr. Barnett: Yet you borrowed money from a taxicab driver?—Yes. I was out of work at the time.
    Yet, in spite of these bad times, you reduced your overdraft?—Yes.
    Lost £700 in Business.
    He had sold a house at West End for £320, which he had spent. Ninety pounds was paid to a friend who had lent him that amount in small sums. His wife's illness cost him £100. During the last few years he had lost £700 in the fruit business. He reduced his overdraft at the bank only by selling everything that he had.
    In reply to the Registrar, witness said that he got only £320 of £450 with which he had been credited. It was not true that he had told one of his creditors that he would much rather go to Boggo-road than pay him.
    Witness said that he had borrowed £95 in small sums from a man named Kanitos three years ago.
    The Registrar. That man was insolvent three years ago. It is to be hoped that you did not help him to keep that money out of the hands of the official receiver.
    Witness said that he had lost money steadily during the last three years.
    Mr. Barnett: Yet last year you bought two businesses—one in West End and one in George-street?
    Witness: Yes.
    The Registrar: It seems clear to me that you could have paid this £400 if you had wanted to.
    The examination was adjourned until Thursday next.5
