  • 19 Feb 1879: BERWICK POLICE COURT. Friday, 14th Feb. (Before Mr. J. Wilson and Dr. Elmes.)
    Saml. Rudduck, (administrator of the late S. Rudduck) v Abraham Ward ; an application for warrant of ejectment to recover possession of premises, which plaintiff stated defendant had rented for some years.
    Mr. Wisewould appeared for complainant, and Messrs. W. A. A'Beckett and Jennings for defendant. A lease of the land was produced, and also various receipts for monies paid as rent for the land through Mr. Ashley. The defence was that the late Mr. Rudduck had purchased the land with money he lent defendant for the purpose, and defendant urged that the monies paid were in re-payment of the loan and not for the rent. The Bench ordered a warrant of ejectment to issue ; execution to be stayed for twenty-eight days. Mr. A'Beckett applied to the Bench to state a case, but the Bench objected, as there were no sufficient grounds for doing so, but informed Mr. A'Beckett that he could apply for a prohibition.7
